When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Use By Minors

The Services are not directed to individuals under the age of thirteen (13), and we request that they not provide Personal Data through the Services.

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

Booking Policies

I. Appointment fees. Appointments fees are paid at the time of booking. No shows and late cancellations for fittings will incur a $15 fee. A valid credit card is required to book a fitting with Hemster.

Alterations

I. Deposits and Invoicing. After the fitting, the invoice is due before the order is processed. All alterations agreements are final.

Any changes in Client’s measurements after the first fitting which cause additional or different Services to be rendered are subject to additional charges. Any customization in the design of a garment, are based on the information provided at the time of Client’s initial request for such customization. Any changes in the design by the Client after this initial request are subject to additional charges.

II. Fittings, Acceptance.
Hemster will begin to perform the Services upon receiving the garment. Services provided are based on the measurements provided at the time of the Client’s fitting or order submittal. Any measurements set forth on the invoice shall be conclusive evidence of the Client’s measurements at the time of the first fitting or order submittal. Hemster cannot be held responsible for garments that do not fit properly due to weight loss or gain, pregnancy, surgery, failure to wear the same shoes or undergarments from the first fitting, etc.

Any cancellations or reschedules of second, third, or final fittings made within 48 hours are subject to a $15 appointment fee.

All concerns or complaints are to be addressed with Hemster during the fitting process and before the final fitting. In the event of a disagreement, any and all resolutions will be at the discretion and sole responsibility of Hemster. Should the Client neglect to come for a scheduled fitting, Hemster is not liable for the fit or finish work of the garment.

III. Delivery.
All accounts must be paid in full before the Client’s garment can be released. Once the garment leaves Hemster’s possession, Hemster is not held responsible for the garment.

IV. No Refunds.
Payments are nonrefundable. At any time, and for any reason, and to the extent permitted by law, Hemster may provide a refund, discount, or other consideration to some or all of our clients. The amount and form of such credits, and the decision to provide them, are at Hemster's sole and absolute discretion to the extent permitted by law. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.

V. Warranty Disclaimer.
The Client acknowledges Hemster makes no guarantee as to the fit of any garments before or after services are performed. Unless otherwise expressly provided herein, all services are provided as-is, and Hemster hereby disclaims any and all representations and warranties, express or implied, including without limitation the warranty of merchantability, fitness of a particular purpose.

VI. Limitation of Liability.
 In no event will Hemster be held liable for any indirect, incidental, special, punitive, consequential, exemplary or similar damages including without limitation, lost profits, loss of use, pain and suffering or mental anguish, related to or arising out of the Services provided. In no event will Hemster be held liable for any direct damages related to or arising out of the services in excess of the price paid by the Client for the service which is the subject of the claim.

VII. Force Majeure.
Any delay or failure in the performance by Hemster shall be excused if and to the extent caused by the occurrence of a Force Majeure. Force Majeure shall mean a cause or event that is not reasonably caused by or under the control of Hemster, including acts of God, fires, floods, explosions, riots, wars, hurricane, terrorism, vandalism, governmental acts, injunctions, labor strikes, and errors or omissions of a manufacturer or its distributor.

VIII. Right of Refusal.
Hemster and/or their contracted seamstresses preserve the right to refuse alterations to any individual under any circumstances at any time.

IX. Acknowledgement.
These Terms and Conditions, including all documents referenced herein, represent the entire understanding between you and Hemster and supersede any other agreements, statements, or representations with the Client and Hemster. Headings used in these Terms and Conditions are for reference only, and shall not affect the meaning of any terms. Any Client of Hemster is deemed to have accepted these Terms and Conditions and the Hemster Privacy Policy. Hemster reserves the right to change or cancel the terms of service at any time
